1. Agreement

These terms are between you and Creativ Digital Agency, Romania ("we", "us"). By using XrayDent AI you accept them. If you do not accept them, do not use the app.

2. What XrayDent AI is — and what it is not

XrayDent AI uses artificial intelligence to produce draft documentation from dental radiographs: a list of observations, a clinical note, suggested next steps, and a plain-language summary.

It is not a medical device. It does not diagnose. It does not replace clinical examination or professional judgement.

Read that plainly: every output is a draft for a licensed dentist to check against the original radiograph. The AI can miss findings that are present. It can report findings that are not. It cannot assess pain, tooth vitality, pocket depths, mobility or soft tissue, because a radiograph does not show them.

We have not sought and do not hold clearance from the FDA, a CE marking under the EU Medical Device Regulation, or any equivalent approval.

3. Who may use it

You must be at least 18.

Dental professional accounts. By selecting the dental professional role you confirm you are qualified and licensed to practise dentistry in your jurisdiction, and that you are permitted to process the patient data you upload.

Patient accounts. The app can help you understand a radiograph your dentist has taken. It cannot tell you whether you need treatment, and it is not a second opinion. Always discuss your radiograph with your dentist.

4. Your responsibilities as a clinician

If you use XrayDent AI professionally, you agree that:

• You will review every finding against the source radiograph before relying on it or entering it in a patient record.
• You remain solely responsible for diagnosis, treatment planning and every clinical decision. Nothing produced by this app transfers any part of that responsibility to us.
• You will not present AI-drafted text to a patient or a third party as though a clinician had written it. The app's export marks AI-drafted and clinician-authored text separately, and requires you to confirm your review before a PDF can be produced. You must not circumvent that.
• You have the lawful basis and the consent required to upload your patients' radiographs.
• You will comply with the professional and record-keeping obligations that apply to you.

5. Credits and payment

Interpretations are paid for with credits.

• New accounts receive a small number of free trial credits.
• Credits are bought through Google Play. We never see your payment details.
• One credit is consumed per completed interpretation.
• If an interpretation fails, no credit is charged.
• If you upload an image that is not a dental radiograph, the app tells you so and no credit is charged.
• Credits do not expire and are tied to your account.
• Credits have no cash value, cannot be transferred between accounts, and cannot be exchanged for money.

Refunds.Purchases are handled by Google Play and Google's refund policy applies. If you are an EU consumer you normally have a 14-day right of withdrawal for digital content; by purchasing and immediately using credits you consent to immediate performance and acknowledge that the right of withdrawal is lost for credits you have consumed. Unconsumed credits remain refundable within that period. Nothing here limits your statutory rights.

Price changes. We may change credit prices. Credits already purchased are unaffected.

6. Acceptable use

Do not:

• Upload images you have no right to upload.
• Upload anything that is not a dental radiograph in order to probe or misuse the service.
• Attempt to extract, reverse engineer or resell the underlying model or prompts.
• Use automated means to create accounts or consume trial credits.
• Present the app's output as a diagnosis, or as the work of a clinician who did not review it.
• Use the service to provide clinical advice if you are not qualified to do so.

We may suspend or terminate an account that breaches these terms.

7. Your content

Radiographs, patient references and notes you upload remain yours. We claim no ownership.

We use them only to provide the service: to generate the report you asked for and to store it in your account. We do not use your radiographs or reports to train any AI model, and our AI provider is contractually barred from doing so either (see our Privacy Policy).

You can delete any case, or your entire account, at any time from within the app (see our account deletion page).

8. Our content

The app, its interface, its prompts and the XrayDent AI name and mark are ours. The reports generated for you are yours to use in your practice.

9. Availability

We aim to keep the service available but do not guarantee it. It depends on third-party infrastructure, and we may suspend it for maintenance or change or withdraw features. We will not remove your ability to export your data without reasonable notice.

10. Disclaimers and liability

The service is provided "as is". To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and accuracy.

We are not liable for clinical decisions.Because every output requires clinician review before use, we are not liable for any loss, injury or claim arising from a diagnosis, a treatment decision, a missed finding or an incorrect finding — whether or not the app's output contributed to it.

Where liability cannot lawfully be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or EUR 100.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.

11. Indemnity

If you use the service professionally, you agree to indemnify us against claims arising from your use of it in breach of these terms — in particular from uploading data you had no right to upload, or from presenting unreviewed output as clinical fact.

12. Ending your use

You may stop at any time and delete your account from Settings. Deletion is permanent and removes every patient record and report. Unused credits are lost on deletion and are not refunded.

We may terminate your access for a material breach of these terms, and will give notice and an opportunity to export your data unless doing so is unlawful or would cause harm.

13. Changes

We may update these terms. If a change is material we will tell you in the app before it takes effect. Continuing to use the service after that means you accept the change.

14. Governing law

These terms are governed by the laws of Romania, and the courts of Romania have jurisdiction. If you are a consumer resident elsewhere in the EU, you keep the protection of the mandatory consumer laws of your country of residence and may bring proceedings there.
